• Reporting and analytics dashboards
• Integration with third-party platforms
3. Eligibility
By using our services, you represent and warrant that:
• You are at least 18 years of age
• You have the legal authority to enter into these Terms on behalf of yourself or your business
• You will use the services solely for lawful business purposes
4. A2P (Application-to-Person) SMS Messaging Terms
By providing your mobile phone number and agreeing to these Terms, you expressly consent to receive SMS text messages from Trustify and/or Magstackz LLC in connection with our services, including but not limited to:
• Review request messages sent on your behalf to your customers
• Service updates, alerts, and notifications
• Account-related communications
4.1 Message Frequency
Message frequency will vary depending on your service plan and the volume of customer interactions. You may receive multiple messages per day depending on your campaign settings.
4.2 Message and Data Rates
Message and data rates may apply. You are responsible for any charges imposed by your mobile carrier. Trustify is not responsible for any carrier fees.
4.3 Opt-Out
You may opt out of receiving SMS messages at any time by replying STOP to any message you receive. After opting out, you will receive a one-time confirmation message. No further messages will be sent unless you re-subscribe.
4.4 Help
For help or more information, reply HELP to any SMS message or contact us at the details provided in Section 1. You may also contact your wireless carrier for additional support.
4.5 Customer SMS on Your Behalf
If you use Trustify to send review request messages to your own customers, you represent and warrant that:
• You have obtained express written consent from each recipient prior to sending any SMS message
• Your customer list complies with all applicable laws, including the Telephone Consumer Protection Act (TCPA) and any applicable state regulations
• You will maintain records of all consents obtained
• You will immediately honor any opt-out requests from your customers
Magstackz LLC is not liable for any violation of applicable messaging laws arising from your use of the platform to contact your customers.
5. Acceptable Use Policy
You agree not to use the Trustify platform to:
• Send unsolicited messages (spam) to consumers who have not consented to receive communications
• Solicit or incentivize fraudulent, fake, or misleading reviews in violation of platform policies (including Google's review policies)
• Engage in any deceptive, misleading, or unfair business practice
• Violate any applicable law, regulation, or third-party platform terms of service
• Transmit harmful, abusive, defamatory, or objectionable content
• Attempt to gain unauthorized access to our systems or another user's account
We reserve the right to suspend or terminate your account immediately for any violation of this Acceptable Use Policy.
6. Account Registration and Security
To access our services, you must create an account. You agree to:
• Provide accurate, current, and complete registration information
• Maintain the security of your password and account credentials
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activity that occurs under your account
We reserve the right to refuse service, terminate accounts, or remove content at our sole discretion.
7. Payment Terms
Certain services on Trustify require payment of fees. By subscribing to a paid plan, you agree to:
• Pay all applicable fees as described at the time of purchase
• Authorize us to charge your provided payment method on a recurring basis for subscription plans

All fees are non-refundable unless otherwise stated in a separate agreement or required by law. We reserve the right to modify pricing with advance notice to subscribers.
8. Intellectual Property
All content, software, trademarks, trade names, logos, and materials on the Trustify platform are the property of Magstackz LLC or its licensors and are protected by applicable intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our services or software without our express written permission.
9. Third-Party Platforms
Our services interact with third-party platforms such as Google, Yelp, Facebook, and others. Your use of those platforms is governed by their respective terms of service and privacy policies. Magstackz LLC is not affiliated with, endorsed by, or responsible for any third-party platform. We do not guarantee outcomes on third-party platforms, including the removal or posting of reviews.
10. Disclaimer of Warranties
THE TRUSTIFY PLATFORM AND ALL SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, MAGSTACKZ LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE THREE (3) MONTHS PRECEDING THE CLAIM.
12. Indemnification
You agree to indemnify, defend, and hold harmless Magstackz LLC, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with:
• Your use of the services
• Your violation of these Terms
• Your violation of any applicable law or third-party rights
• Any SMS or other communications sent to your customers through our platform
13. Privacy Policy
Your use of our services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using Trustify, you consent to the collection, use, and sharing of your information as described in our Privacy Policy available at trytrustify.com/privacy.
14. Modifications to Terms
We reserve the right to update or modify these Terms at any time. When we do, we will update the Effective Date at the top of this page. Your continued use of the services after any changes constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.
15. Termination
Either party may terminate the service relationship at any time. Upon termination, your right to use the platform will immediately cease. Sections 8, 10, 11, 12, and 16 shall survive termination.
16. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Pinellas County, Florida.
17. Entire Agreement
These Terms, together with our Privacy Policy and any additional agreements you may enter into with us, constitute the entire agreement between you and Magstackz LLC with respect to the subject matter herein, and supersede all prior or contemporaneous communications and proposals.
